TERMS & CONDITIONS
These Terms and Conditions constitute a legally binding agreement between YOU (the “Customer” or “You”) and DACRI’ & CO (the “Seller,” “We,” or “Us”). By making a purchase, placing an order, or otherwise shopping on www.dacri.ch (the “Site”), you agree to be bound by these Terms and Conditions.
These Terms and Conditions may be updated from time to time without prior notice, except that the Terms applicable at the time of your order will govern that specific transaction.
DEFINITIONS & SCOPE
Digital Files are embroidery patterns available for instant download.
Embroidery Supplies include physical products such as threads, stabilizers, and fabrics.
Custom Embroidered Clothing consists of apparel customized according to customer specifications.
Embroidery Digitization Service is a service converting images into machine embroidery files.
These Terms apply to all purchases made through the Site.
ORDERS, PRICING & PAYMENT
Orders are placed via the Site’s checkout system.
Prices are displayed in Swiss Francs (CHF) and are subject to change without notice. A currency converter may be available for informational purposes only.
Payments must be made using methods specified on the Site.
We reserve the right to refuse any order for any reason, including suspected fraud or violation of these Terms.
Your order is confirmed only upon receipt of an order confirmation email.
REFUNDS, RETURNS & CANCELLATIONS
All sales of Digital Files are final. No refunds or exchanges.
Embroidery Supplies and Custom Clothing cannot be returned unless the item is defective or incorrect. Customers must notify Us within 7 days of receipt.
Embroidery Digitization Service orders can be canceled only if the digitization process has not yet started. No refunds after work has begun.
In case of disputes, please contact Us before initiating chargebacks or disputes with your payment provider.
LICENSE & INTELLECTUAL PROPERTY
Digital Files are licensed for personal use only. No resale, redistribution, or commercial use is allowed without a separate commercial license. Unauthorized sharing or modification is prohibited. Violating these terms will result in immediate license termination and potential legal action.
For the Embroidery Digitization Service, you warrant that you have the right to use any images submitted for digitization. We retain the right to refuse digitization of copyrighted or inappropriate content.
All content on the Site, including images, text, patterns, and designs, is protected by copyright laws.
LIABILITY & WARRANTIES
Products and services are provided “as is” without any express or implied warranties.
We are not responsible for errors arising from modifications to Digital Files, compatibility issues with embroidery software or machines, or loss of downloaded files (customers should store backups).
Our liability is limited to the amount paid by the customer in the 12 months preceding the claim.
ACCOUNT MANAGEMENT
Your account is personal and must not be shared.
Excessive downloads from different devices may result in account suspension.
It is your responsibility to download purchased digital files in a timely manner.
SHIPPING POLICY
We ship orders within Switzerland using Swiss Post.
International orders are shipped using DHL or other carriers, depending on the destination.
Shipping times and costs vary based on the location and selected shipping method.
Any applicable customs duties and import taxes are the responsibility of the customer.
PRIVACY POLICY
Our Privacy Policy explains how we collect, process, and store your personal information.

GOVERNING LAW & DISPUTE RESOLUTION

DEFINIZIONI E AMBITO
I File Digitali sono schemi di ricamo disponibili per il download immediato.
I Materiali per Ricamo includono prodotti fisici come fili, stabilizzatori e tessuti.
L’Abbigliamento Ricamato su Misura consiste in capi personalizzati secondo le specifiche del cliente.
Il Servizio di Digitalizzazione del Ricamo è un servizio che converte immagini in file per macchine da ricamo.
Questi Termini si applicano a tutti gli acquisti effettuati tramite il Sito.
ORDINI, PREZZI E PAGAMENTI
Gli ordini vengono effettuati tramite il sistema di checkout del Sito.
I prezzi sono visualizzati in Franchi Svizzeri (CHF) e possono essere modificati senza preavviso. Un convertitore di valuta può essere disponibile solo a scopo informativo.
I pagamenti devono essere effettuati utilizzando i metodi specificati sul Sito.
Ci riserviamo il diritto di rifiutare qualsiasi ordine per qualsiasi motivo, incluso il sospetto di frode o violazione di questi Termini.
L’ordine è confermato solo al ricevimento di un’email di conferma dell’ordine.
RIMBORSI, RESI E CANCELLAZIONI
Tutte le vendite di File Digitali sono definitive. Nessun rimborso o cambio.
I Materiali per Ricamo e l’Abbigliamento Personalizzato non possono essere restituiti, salvo che il prodotto sia difettoso o errato. I clienti devono avvisarci entro 7 giorni dalla ricezione.
Gli ordini per il Servizio di Digitalizzazione del Ricamo possono essere cancellati solo se il processo di digitalizzazione non è ancora iniziato. Nessun rimborso sarà concesso dopo l’inizio del lavoro.
In caso di controversie, ti invitiamo a contattarci prima di avviare chargeback o dispute con il tuo fornitore di pagamento.
LICENZA E PROPRIETÀ INTELLETTUALE
I File Digitali sono concessi in licenza solo per uso personale. Non è consentita la rivendita, la redistribuzione o l’uso commerciale senza una licenza commerciale separata. La condivisione o la modifica non autorizzata è vietata. La violazione di questi termini comporterà l’immediata cessazione della licenza e potenziali azioni legali.
Per il Servizio di Digitalizzazione del Ricamo, garantisci di avere il diritto di utilizzare le immagini inviate per la digitalizzazione. Ci riserviamo il diritto di rifiutare la digitalizzazione di contenuti protetti da copyright o inappropriati.
Tutti i contenuti presenti sul Sito, inclusi immagini, testi, schemi e design, sono protetti dalle leggi sul copyright.
RESPONSABILITÀ E GARANZIE
I prodotti e i servizi sono forniti “così come sono” senza alcuna garanzia espressa o implicita.
Non siamo responsabili per errori derivanti da modifiche ai File Digitali, problemi di compatibilità con software o macchine da ricamo, o perdita di file scaricati (i clienti devono conservarne una copia di backup).
La nostra responsabilità è limitata all’importo pagato dal cliente nei 12 mesi precedenti il reclamo.
GESTIONE DELL’ACCOUNT
Il tuo account è personale e non deve essere condiviso.
Download eccessivi da dispositivi diversi possono comportare la sospensione dell’account.
È tua responsabilità scaricare i file digitali acquistati in modo tempestivo.
POLITICA DI SPEDIZIONE
Spediamo gli ordini in Svizzera tramite Swiss Post.
Gli ordini internazionali vengono spediti tramite DHL o altri corrieri, a seconda della destinazione.
I tempi e i costi di spedizione variano in base alla località e al metodo di spedizione selezionato.
Eventuali dazi doganali e tasse di importazione sono a carico del cliente.

DEFINITIONEN & ANWENDUNGSBEREICH
Digitale Dateien: Stickmuster, die zum sofortigen Download verfügbar sind.
Stickzubehör: Physische Produkte wie Garne, Stabilisatoren und Stoffe.
Individuell bestickte Kleidung: Bekleidung, die nach den Kundenspezifikationen individuell angefertigt wird.
Stick-Digitalisierungsdienst: Ein Service, der Bilder in Dateien für Stickmaschinen umwandelt.
Diese Bedingungen gelten für alle über die Seite getätigten Käufe.
BESTELLUNGEN, PREISGESTALTUNG & ZAHLUNG
Bestellungen werden über das Kassensystem der Seite aufgegeben.
Die Preise werden in Schweizer Franken (CHF) angezeigt und können ohne Vorankündigung geändert werden. Ein Währungsumrechner kann ausschließlich zu Informationszwecken zur Verfügung stehen.
Zahlungen müssen mit den auf der Seite angegebenen Zahlungsmethoden erfolgen.
Wir behalten uns das Recht vor, jede Bestellung aus beliebigen Gründen abzulehnen, einschließlich des Verdachts auf Betrug oder eines Verstoßes gegen diese Bedingungen.
Ihre Bestellung wird erst nach Erhalt einer Bestätigungs-E-Mail bestätigt.
RÜCKERSTATTUNGEN, RÜCKSENDUNGEN & STORNIERUNGEN
Alle Verkäufe von digitalen Dateien sind endgültig. Es gibt keine Rückerstattungen oder Umtausch.
Stickzubehör und individuell bestickte Kleidung können nur zurückgegeben werden, wenn der Artikel defekt oder fehlerhaft ist. Der Kunde muss uns innerhalb von 7 Tagen nach Erhalt benachrichtigen.
Bestellungen für den Stick-Digitalisierungsdienst können nur storniert werden, sofern der Digitalisierungsprozess noch nicht begonnen hat. Nach Beginn der Arbeiten erfolgt keine Rückerstattung.
Im Falle von Streitigkeiten kontaktieren Sie uns bitte, bevor Sie eine Rückbuchung oder einen Streit mit Ihrem Zahlungsanbieter einleiten.
LIZENZ & GEISTIGES EIGENTUM
Digitale Dateien sind ausschließlich für den persönlichen Gebrauch lizenziert. Ein Weiterverkauf, eine Weitergabe oder eine kommerzielle Nutzung ist ohne separate kommerzielle Lizenz nicht gestattet. Unbefugtes Teilen oder Verändern ist untersagt. Die Verletzung dieser Bedingungen führt zur sofortigen Beendigung der Lizenz und kann rechtliche Schritte nach sich ziehen.
Für den Stick-Digitalisierungsdienst versichern Sie, dass Sie das Recht haben, alle zur Digitalisierung eingereichten Bilder zu verwenden. Wir behalten uns das Recht vor, die Digitalisierung von urheberrechtlich geschütztem oder unangemessenem Inhalt abzulehnen.
Alle Inhalte auf der Seite, einschließlich Bilder, Texte, Muster und Designs, sind durch Urheberrechtsgesetze geschützt.
HAFTUNG & GEWÄHRLEISTUNGEN
Produkte und Dienstleistungen werden „wie besehen“ bereitgestellt, ohne ausdrückliche oder stillschweigende Gewährleistungen.
Wir übernehmen keine Verantwortung für Fehler, die durch Änderungen an digitalen Dateien, Kompatibilitätsprobleme mit Sticksoftware oder -maschinen oder den Verlust heruntergeladener Dateien entstehen (Kunden sollten Sicherungskopien anlegen).
Unsere Haftung ist auf den vom Kunden in den 12 Monaten vor der Reklamation gezahlten Betrag begrenzt.
KONTOVERWALTUNG
Ihr Konto ist persönlich und darf nicht geteilt werden.
Übermäßige Downloads von verschiedenen Geräten können zur Sperrung Ihres Kontos führen.
Es liegt in Ihrer Verantwortung, die gekauften digitalen Dateien rechtzeitig herunterzuladen.
VERSANDRICHTLINIEN
Wir versenden Bestellungen innerhalb der Schweiz mit der Schweizer Post.
Internationale Bestellungen werden je nach Zielort mit DHL oder anderen Versanddienstleistern verschickt.
Lieferzeiten und -kosten variieren je nach Standort und gewählter Versandmethode.
Etwaige anfallende Zollgebühren und Einfuhrsteuern gehen zu Lasten des Kunden.

Service de numérisation de broderie : un service permettant de convertir des images en fichiers de broderie pour machine.
Ces conditions s’appliquent à tous les achats effectués via le Site.
COMMANDES, TARIFICATION ET PAIEMENT
Les commandes sont passées via le système de paiement du Site.
Les prix sont affichés en francs suisses (CHF) et sont susceptibles de changer sans préavis. Un convertisseur de devises peut être mis à disposition à titre informatif uniquement.
Les paiements doivent être effectués en utilisant les moyens spécifiés sur le Site.
Nous nous réservons le droit de refuser toute commande pour quelque raison que ce soit, y compris en cas de suspicion de fraude ou de violation de ces conditions.
Votre commande n’est confirmée qu’après réception d’un e-mail de confirmation.
REMBOURSEMENTS, RETOURS ET ANNULATIONS
Toutes les ventes de fichiers numériques sont définitives. Aucun remboursement ni échange n’est possible.
Les fournitures de broderie et les vêtements personnalisés ne peuvent être retournés que si l’article est défectueux ou incorrect. Le client doit nous en informer dans les 7 jours suivant la réception.
Les commandes relatives au service de numérisation de broderie peuvent être annulées uniquement si le processus de numérisation n’a pas encore commencé. Aucun remboursement n’est possible une fois le travail entamé.
En cas de litiges, veuillez nous contacter avant d’initier une rétrofacturation ou toute contestation auprès de votre fournisseur de paiement.
LICENCE ET PROPRIÉTÉ INTELLECTUELLE
Les fichiers numériques sont concédés sous licence pour un usage personnel uniquement. La revente, la redistribution ou l’utilisation commerciale ne sont autorisées qu’avec une licence commerciale distincte. Le partage ou la modification non autorisés sont interdits. La violation de ces conditions entraînera la résiliation immédiate de la licence et pourra donner lieu à des poursuites judiciaires.
Pour le service de numérisation de broderie, vous garantissez que vous disposez du droit d’utiliser toutes les images soumises à la numérisation. Nous nous réservons le droit de refuser la numérisation de contenus protégés par des droits d’auteur ou inappropriés.
L’ensemble du contenu du Site, y compris les images, textes, motifs et designs, est protégé par les lois sur le droit d’auteur.
RESPONSABILITÉ ET GARANTIES
Les produits et services sont fournis « tels quels », sans aucune garantie expresse ou implicite.
Nous ne sommes pas responsables des erreurs résultant de modifications apportées aux fichiers numériques, des problèmes de compatibilité avec les logiciels ou machines de broderie, ou de la perte de fichiers téléchargés (les clients doivent en conserver des copies de sauvegarde).
Notre responsabilité est limitée au montant payé par le client au cours des 12 mois précédant la réclamation.
GESTION DU COMPTE
Votre compte est personnel et ne doit pas être partagé.
Des téléchargements excessifs à partir de différents appareils peuvent entraîner la suspension de votre compte.
Il vous incombe de télécharger les fichiers numériques achetés en temps utile.
POLITIQUE D’EXPÉDITION
Nous expédions les commandes en Suisse via la Poste Suisse.
Les commandes internationales sont expédiées via DHL ou d’autres transporteurs, en fonction de la destination.
Les délais et frais de livraison varient en fonction de la localisation et du mode d’expédition sélectionné.
Les droits de douane et taxes d’importation applicables sont à la charge du client.
